How to Transfer Land Title After a Parent Dies in the Philippines

If there is no will and no debts, heirs may settle extrajudicially: publish the deed, pay BIR estate tax, get the eCAR, then register the new title.

If your parent left no will and no debts, you and your co-heirs can transfer the land yourselves, without a court case: sign a notarised Deed of Extrajudicial Settlement, publish it once a week for three consecutive weeks, pay the estate tax to the BIR and secure the eCAR, then register with the Registry of Deeds. The title does not move until the estate is settled and the estate tax is paid.

Nanay died in 2021. The lot in Buhangin is still in her name. There was a wake, then the pandemic, then years of nothing, the real property tax still paid under her name. Then a buyer offered a fair price, asked for a photocopy of the title, and everything stopped. Here is the order it has to happen in.

The title does not move on its own

Legally, your rights vested at her death. Article 777 of the Civil Code transmits the rights to the succession from the moment of death, so you became a co-owner that day. But the title carries her name, and the Registry knows only what is on paper.

When you can settle without going to court

Rule 74, Section 1 of the Rules of Court lets heirs divide an estate themselves, no case needed, if:

The decedent left no will.
The estate has no debts.
All heirs are of age, or a minor is represented by a duly authorized judicial or legal representative.
Everyone agrees on the division.

The heirs sign a public instrument, a notarized Deed of Extrajudicial Settlement, and file it with the Registry of Deeds. A sole heir files an affidavit of self-adjudication instead.

One caution sits in that same section: "no extrajudicial settlement shall be binding upon any person who has not participated therein or had no notice thereof." Leaving a sibling out does not remove the problem. It preserves it.

If any condition fails, the estate goes to court: probate of the will, or letters of administration under a judge.

The publication is not a formality

Section 86 of Presidential Decree No. 1529, the Property Registration Decree, is blunt: no deed of extrajudicial settlement or affidavit of adjudication may be registered unless it is published once a week for three consecutive weeks in a newspaper of general circulation in the province, with proof filed with the Register of Deeds.

Three insertions, a week apart. Keep the publisher's affidavit and the actual issues.

The BIR comes before the Registry

Section 95 of the Tax Code bars the Register of Deeds from registering a transfer by inheritance without the Commissioner's certification that the estate tax has been paid. That certification is the eCAR, the Electronic Certificate Authorizing Registration. No eCAR, no new title.

The return is due within one year from death under Section 90(B) of the Tax Code, as amended by the TRAIN Law (Republic Act No. 10963). The rate is six percent of the net estate. Citizens and residents get a five-million-peso standard deduction, plus the decedent's share in the family home, up to ten million pesos of its fair market value, on barangay certification that it was the actual family home. Section 91(C) allows installments within two years of the statutory date, without civil penalty and interest.
