Before you engage
Bank disputes are won or lost on records and timelines, so the first step is to put it in writing. Report the unauthorized transaction or the error to your bank at once and ask for a written acknowledgment and a reference number, because most banks and the Bangko Sentral expect you to raise it with the bank first. Keep your passbook, statements, transaction receipts, text and email alerts, screenshots, and every reply, and note the dates and the names of the people you dealt with. Whether the bank must reverse a charge or release an account turns on the facts, the proof of who authorized what, and the rules under RA 8791 and RA 11765, so no honest lawyer can promise how it will end. What the firm can do is press the complaint, escalate to the BSP where it qualifies, and bring the civil case if the bank will not make it right.

Questions
Report it to your bank in writing right away, ask them to flag and investigate the transaction, and get a written acknowledgment with a reference number. Save your statements, receipts, alerts, and every reply. Under RA 11765 the bank must look into a disputed transaction, but whether it reverses the charge depends on the facts and on the proof of who authorized it, so we cannot promise the money back. If the bank refuses without good reason, the next steps are escalation to the Bangko Sentral and, if needed, a civil case.
Possibly. A check wrongly dishonored when the account could cover it is a recognized wrong, and the law may allow recovery of the resulting loss and the harm to reputation the law recognizes. Much depends on the bank's records and on showing the funds were available, so the outcome is never certain. The firm reviews the statements and the bank's own logs, sends a demand, and pursues the claim if the facts support it.
As a rule, yes. The Bangko Sentral's consumer-assistance process generally expects you to raise the matter through the bank's own complaint channel first and give it a chance to respond. If the bank does not resolve it fairly, the complaint can be escalated to the BSP, and a civil action remains available. The firm handles each stage in order and keeps you informed of where your case stands.
