Scope
Defective brand-new motor vehicles that the dealer cannot repair after repeated attempts, where the Lemon Law (RA 10642) may allow repair, replacement, or a refund

Before you engage
A consumer claim stands or falls on records and on following the right steps in the right order. Keep your sales invoice, the warranty card, the order or chat history, every repair or service record with its dates, and your photos or videos of the defect. For a brand-new vehicle, the Lemon Law (RA 10642) does not give an instant refund: it generally requires a written demand and a number of repair attempts within the law's coverage period before replacement or refund is on the table, and the manufacturer is usually given the first chance to fix or replace before money is returned. For other goods, RA 7394 routes most disputes through a DTI complaint before court. Whether you recover repair, replacement, refund, or damages depends on the facts, the proof, and the law, so no honest lawyer can promise a particular result. The Lemon Law (RA 10642) usually requires you to give the manufacturer or dealer written notice and a set number of repair attempts within the law's coverage period before replacement or refund is available, and the manufacturer is generally given the first chance to fix or replace. Whether you reach a refund depends on the repair history and the proof you kept. The firm will tell you honestly where your case sits rather than promise a particular outcome.
For most consumer goods under RA 7394, the usual first step is a complaint with the Department of Trade and Industry, which offers mediation and an adjudication process, not court right away. Many disputes are also resolved by a demand letter or settlement. Court is for when those steps do not work or the law calls for it. The firm will recommend the route that fits your facts and explain the trade-offs.
Keep the sales invoice or receipt, the warranty card or terms, the order and any chat or email history, every repair or service record with dates, and photos or videos of the defect. Do not return or repair the item in a way that erases the evidence before you get advice.
