How Voters Can Recall A Local Official

Recall lets registered voters remove a provincial, city, municipal, or barangay official for loss of confidence. Here is how the process actually works.

When a mayor or a barangay captain loses the trust of the people who put them in office, the next election can feel very far away. The law does not leave voters stuck waiting. Under the Local Government Code, registered voters can move to remove a local official before the term ends. It is called recall, and it runs on loss of confidence, not on a court case.

What recall is, and who it covers

Recall is the power of the registered voters of a local government unit to remove the elective official they voted into that unit, for loss of confidence (Republic Act No. 7160, Section 69). It reaches provincial, city, municipal, and barangay officials: governors, mayors, vice mayors, sanggunian members, punong barangay, and barangay kagawad.

Loss of confidence is the only ground. You do not have to prove graft or a crime. Recall is a political remedy, a way for voters to say the person no longer has their support. Wrongdoing may be why people feel that way, but the case rises or falls on the voters, not on evidence weighed in a courtroom.

How a recall starts

Republic Act No. 9244 (2004) changed how recall begins. It removed the old preparatory recall assembly of local officials, so today recall is a voters' petition, period.

A registered voter files the petition, and it has to be supported by a share of the voters who cast ballots in the election that put the official in office (RA 7160, Section 70, as amended by RA 9244):

at least 25% where the voting population is 20,000 or less
at least 20% for 20,000 up to 75,000, but never fewer than 5,000 voters
at least 15% for 75,000 up to 300,000, but never fewer than 15,000
at least 10% above 300,000, but never fewer than 45,000

The petition goes to the COMELEC office in the local government unit. COMELEC has 15 days to certify whether the signatures are enough; fall short and the petition is automatically void. If it is sufficient, COMELEC gives the official a copy, publishes the petition once a week for three weeks, and verifies the signatures, with both sides allowed to watch.

The recall election

Recall is decided at the polls, not by the petition alone. Once a valid petition clears the process, COMELEC sets the recall election within 30 days for barangay, city, and municipal officials, or 45 days for provincial officials (Section 71, as amended).

Here is the part people miss. The official being recalled is automatically a candidate, and the seat goes to whoever gets the most votes (Section 72). If the incumbent tops the count, confidence is affirmed and they stay. Recall is a contest for the position, not a simple yes-or-no on one person. The official also cannot resign while the process is running (Section 73).

Timing limits

There are firm limits (Section 74). An official can face recall only once per term. No recall in the first year after they assume office, and none within the year right before a regular local election. The Supreme Court in Claudio v. COMELEC (G.R. Nos. 140560 and 140714, 4 May 2000) read the one-year bar as pointing to the recall election itself, and treated a regular local election as the election for that same office.
