Quasi-delict: claiming damages when negligence hurts you

A plain guide to quasi-delict under the Civil Code: how to claim damages for negligence, sue the employer, and win even if the driver is acquitted.

A tricycle clips your car at an intersection. A delivery rider on the wrong side of the road sends you to the hospital. A construction crew drops something and dents your parked motorbike. The driver says sorry, then says he has nothing. So do you just eat the cost?

No. Philippine law gives you a civil claim called a quasi-delict, and it does not wait for anyone to go to jail first.

What a quasi-delict is

Article 2176 of the Civil Code (Republic Act No. 386) puts it plainly: whoever, by act or omission, causes damage to another through fault or negligence, must pay for the damage done. If there was no contract between you and the person who hurt you, that fault or negligence is called a quasi-delict, or in the old textbooks, culpa aquiliana. This is the everyday basis for most road-accident and injury claims in the country.

To recover, you generally show three things: someone was negligent, you suffered damage, and that negligence caused the damage. You prove it by preponderance of evidence, a lighter standard than the proof beyond reasonable doubt needed to convict someone of a crime.

You can go after the employer, not just the driver

This is the part people miss. Under Article 2180, an employer is liable for the damage caused by an employee acting within the scope of his assigned tasks. So if a company truck or a courier rider hits you, you can sue the company directly, not only the barely paid driver. The employer escapes only by proving it observed the diligence of a good father of a family in choosing and supervising that employee, which is hard to show in practice. The Supreme Court settled this direct, primary liability long ago in Barredo v. Garcia and Almario (G.R. No. 48006, 8 July 1942).

It does not wait for the criminal case

A road crash can be both a crime and a quasi-delict. Article 2177 keeps the two separate: your civil claim for negligence stands apart from any criminal liability, though you cannot collect twice for the same injury. For defamation, fraud, and physical injuries, Article 33 lets you file a civil action that proceeds independently of the criminal case and needs only preponderance of evidence.

Here is the point that surprises people. Even if the driver is acquitted in the criminal case, you can still win the civil case for quasi-delict. The Court said as much in Elcano v. Hill (G.R. No. L-24803, 26 May 1977). An acquittal often means the prosecution could not prove guilt beyond reasonable doubt, not that no one was negligent.

When the driver is presumed negligent

Article 2185 gives you a real edge on the road. If the driver was violating a traffic regulation at the time of the mishap, he is presumed to have been negligent, unless he proves otherwise. Beating the red light, counterflowing, speeding, no headlights at night: each one flips the burden onto the driver to explain himself.

What if you were partly at fault

You can still recover. Article 2179 says that if your own negligence was only contributory, and the driver's lack of care was the real, proximate cause, you still collect, but the court reduces the award to reflect your share of the blame. You lose only if your own negligence was the immediate and proximate cause of your injury.
