Why your streaming and apps now add 12% VAT

Your subscriptions quietly got pricier

If your Netflix or Spotify bill crept up around the middle of last year, you were not imagining it. A 12% value-added tax now sits on top of most digital services used in the Philippines. The law behind it is Republic Act No. 12023 (VAT on Digital Services Act), signed on October 2, 2024. The Bureau of Internal Revenue put it into motion through Revenue Regulations No. 3-2025, and foreign providers have been collecting the tax since June 2, 2025.

Here is the plain version, and what it means whether you are paying for a streaming app at home or boosting posts for a small shop in Davao.

What counts as a digital service

RA 12023 covers services delivered over the internet that run largely on their own once you click buy. The BIR lists the usual categories: online search engines, online marketplaces, cloud services, online media and advertising, online platforms, and digital goods. In practice that means streaming video and music, app and game purchases, mobile game top-ups, cloud storage, subscription software, online ads, and the platform fees you pay when you sell through an app.

It does not matter that the company has no office here. If the buyer is in the Philippines, the service is treated as consumed here and the 12% applies. The BIR looks at details like your billing address, payment information, and IP address to decide where you are.

If you are an ordinary user

For most people, there is nothing to file. This is a business-to-consumer (B2C) transaction, so the provider is the one registered with the BIR. It adds the 12% to your bill and remits it. Your only real task is to expect the higher price and budget for it. A stack of monthly subscriptions adds up fast, and the tax is now baked in.

If you run a business, read this part

Here is the part many owners miss. When a business buys digital services from a foreign provider, say boosting posts on Facebook, paying for design software, or renting cloud hosting, it is a business-to-business (B2B) transaction. Under the reverse charge rule, the Philippine buyer, not the foreign seller, accounts for the 12% VAT. You withhold it and remit it to the BIR using BIR Form No. 1600-VT, within ten days after the end of the month.

There is an upside if you are VAT-registered: that remitted amount can be claimed as input VAT, so it is not simply a new cost. Keep the invoices and the filed return as your proof. If you are not VAT-registered, it becomes part of your expense.

This trips up a lot of small enterprises that pay for online ads or software on a company card and never think of it as importing a service. Your recurring charges are worth a second look.

What is exempt

Not everything is taxed. Online courses, seminars, and subscriptions sold to schools accredited by DepEd, CHED, or TESDA, and to government schools, are VAT-exempt, and the school only needs to show its accreditation to claim it (Revenue Memorandum Circular No. 47-2025). Certain bank and financial services delivered through digital platforms are also outside the tax. A personal online course from a non-accredited provider, on the other hand, is generally covered.
